The Equalizer (1985–1989): Season 2, Episode 7 - Counterfire - full transcript

A young man is killed accidentally when a Neighbourhood Watch group startles him. To protect themselves, they make it appear that he was caught in the commission of a crime. The police believe their claim but his mother refuses to believe it is true and contacts McCall to prove it. Her younger son just wants to get a gun and go after them.

You Honor, I object !

My client is a reputable member...

You client is accused of a crime
of premeditated violence.

I did not shoot the man.
I've told you this whole thing is a setup.

The girl can lead McCall to you !

But he won't find her.

I haven't been on the run for years.
Where the hell do I start ?

Please, help me !

- I'm not making any deals.
- I'm not asking for any deals. Just 24 hours

Now this kid's four-year-old
child swallows a ***.

The mother rushed the
kid to the hospital,

waited in the waiting room of
mother's heart, waited an hour.

Finally the doctor came out
with a big smile on his face.

He said the kid is fine, he's
okay, take him home he says.

Just don't point 'im at anybody.

Don't I know you from the wax museum ?
What did you have for dinner ?

***

Listen, what can I expect
from a group six people ?

What do you expect, big laughter ?

This has been my faith.
I worked up in the catskills in a hotel

where business was so bad the boss was
stealing the towels back from the guests.

And then of course I've had a very career.
I'm doing... Television finally called me.

My last shot on television...

I'll tell you how long ago it was.
Carl Morton was still carrying cash.

Listen. Our little rocky is because
I just got off a cruise ship.

That's my favorite medium.

I worked on a ship that was really fun.

When I tell you fun, the highest
ranking officer was the wine store.

And if you want to see people
eat, you'll go on a cruise.

People come aboard as
passengers, they go off as cargo.

Since you've liked my jokes so much...

Hi, I'm Anne. Would you like a table ?

I'm gonna turn you to the band.

- Anne Fitzgerald ?
- Yes.

Robert McCall.

- You left a message on my machine ?
- You got here fast.

I don't live far away and you
sounded desperate anyway, so...

I can take a break now.
Why don't we go this way ?

Fine.

The first one showed up two weeks ago.
Since then I've been reported dead

in every newspaper in the city.

And every single obituary shows
a different cause of death.

And they made sure that
she will receive these ?

I get a copy every morning in the mail.

Someone's getting ready to kill
me, Mr. McCall. I can feel it.

- You went to the police ?
-Yeah, they wrote it of as just a sick joke.

They took copies, but
what what could they do ?

Maybe they're right it's just a joke.

- I was stupid to call you.
- No, no. Not at all, not at all.

But if I'm to help you, ma'am,
you're gonna have to do something for me.

You've got a friend, a close friend
you could stay with for a while?

- My mother ?
- Fine.

Well, you call your mother up and see
if you can stay there for a short time.

And don't tell anybody.

In the meantime, that's my card.

You'll found those numbers
if you need anything.

And I'll see you here,
this time, tomorrow night ?

- What are you gonna do ?
- Oh, I'm gonna knock on a few doors,

see if I can find out who's
playing undertaker. Don't worry.

- Can I help you ? Excuse me !
- This is a great car ! I heard it coming.

- A Jag, am I right ?
- Yes, that's right.

I'm always right. You mind if I look
at it ? It'll only take a second.

- Fine, fine.
- I got a real light touch.

Oh ! You keep it in great shape.
Clean. Polished. A guy with class

always takes care of his car.

Yes. Thank you, thank you.

- If you'll excuse me now...
- Sure, sure, I'm on my way.

Coming !

- Are you Terry ?
- Get out of here, cop !

I'm not a cop.

Well, who are you and
what the hell do you want ?

I want to find out why
you've been going around town

putting our obituaries in newspapers
in the name of Anne Fitzgerald.

- I don't know what you're talking about.
- I think you do.

Every newspaper in town
gives this telephone number

as their source of information.

You know, if something happened,
I didn't have nothing to do with it.

- He told me it was just a joke.
- Who told you ?

- Who told you ?
- I don't know his name.

He was just a john.

- What did look like ?
- Abraham Lincoln on a piece of green paper.

I can't remember. I'm drunk a lot, okay ?
Look, if something happened,

I'm sorry. All I did was call in
the obits and say I was broad sister.

- Honest truth.
- Yeah... Thank you.

Oh God, he hit me! Help !
Some... Call the police !

Come on, you don't think you're
gonna get away with this, do you ?

Oh my leg ! I think it's broken.

What are you talking about broken ?
This is deliberate ! You deliberately ran out

and threw yourself under the
car. Now what's the game ?

- You're not even blind, are you ?
- You leave me alone !

Somebody help me !

Hey, get away from him, man !

Get away from him !
What's the matter with you ?

I tell you, this is a con.

This man ran...

Yeah, but I have a witness who says you
were driving to fast for the condition.

What condition ?

We get all sort of maniacs
like him on the street.

Bad enough we got to deal
with the damn taxicabs.

That man is an accomplice.

I'm telling you to give me your driver's
license before I have to haul you in.

- How's it going, man ?
- The leg's not broken, thank goodness.

I want that man examined by a specialist.

Why don't you just show up in court
and pay the two dollars, Mack ?

Yeah, don't worry.
I'll show up all right.

I'll bring my lawyer with me.

- Let's go get a cup of coffee someplace.
- Okay.

Thank you.

You're not going to get away with
this, you do know that, don't you ?

I was just crossing the street.

Come on. Let's go.

Excuse me.

Can I go now ?

Can I ?
Thank you.

Yes ?

Mr McCall ? This is Anne Fitzgerald.

Please, could I see you ?
I'm at the club. Something's happened.

All right. 20 minutes.

Oh, you did a real good job.

- You got the timing down to the teeth.
- Ah, it's no problem, Mr. Marley.

All I got to do is he'll jump.

You don't cluck your boy here.
He don't even asked how far...

He just feels it.

Yeah, all the same.
You did a fine job.

- Well, I'll catch you guys later,
- Yeah, see you again.

Great.

You know, I'm getting a
little old for this now.

Yeah, yeah. But it's worth it right ?

Ah ! I like doing business
with you, Mr. Marley.

You're a man of class, I can feel it.

I thought I asked you to
start at your mother's.

I did. It showed up at
her house an hour ago.

A death certificate
with your name on it,

- Most creative !
- A few minutes after I came, I got the call.

And you didn't recognize the voice ?

No. He told me to show up in an
hour with twenty thousand dollars.

Where am I gonna get
that kind of money ?

He said if I didn't show
up, he was gonna kill me.

This is fast becoming
my favorite morning.

- Show up where ?
-This address. Fourth floor.

Come on !
I've just been to this hotel.

Wait here.

I want to come with you.
I don't want to be alone.

No, no, wait here, please.

I'm going to settle
this once and for all.

On the gate !

On the gate !

Sit down, McCall.

Bound to end up this way, McCall.

- I did not kill the man.
- How come I don't believe that ?

A man with your record
of shooting incidents.

You were apprehended
by two police officers in an elevator,

where you brutally shot a blind man
who threatened you with a lawsuit.

I did not shoot the man.
Are you sure he's blind ?

Autopsy says so.

Also ballistics is identify the bullet as
coming from the gun found in your possession

- Your gun.
- It was not my gun.

Never seen that gun before in my life.

Here's the gun registration, in your name.

Fake.

I've told you this whole thing is
a setup from the very first moment

that man Clark threw himself onto my car.

And then he shot himself for
you just to make it stick.

I'm having trouble
following your logic, McCall.

- All right. Where's the girl ?
- The one who allegedly set you up ?

Anne Fitzgerald, yes.

There's no one employed at
Teddie's by that name.

- A girl...
- Sit down !

A girl did work there.

She went to stay with her mother.
I gave you the address.

No one's been seen there for
weeks, according to the neighbor.

Then someone's goted the neighbor.

Oh, it's a conspiracy, huh ?

You're beginning to sound like one of
those anti-warren commission fanatics.

- So, you're sticking to this story ?
- I'm sticking to the truth, yes.

You know, you are a very, very
good policeman, lieutenant,

but if you think you can stick
me with a charge of murder,

you must be a fool.

Get him out of here !

Oh shuts !

See, I was hoping I get a chance
to see how you looked at stripes.

That was not one of your better jokes.

All right, I guess it wasn't.

- You all right ?
- I have been better.

I am right, am I not, in assuming that
this is not a setup by one of your people ?

No, no ! Not guilty.

Because there are a few of them were very
pleased about it but, they didn't do it.

Who wants you this bad, Robert ?

It would fill a telephone
book wouldn't it? I don't know.

I don't know. All I know is that I was
set up by a girl and I've got to find her.

You gonna have to make
bail before you do that.

Well, there's not much
chance of that really.

But, just in case, do you
have your checkbook handy.

I don't know. You're good for it.

I'll get somebody to represent you.

Is that it ?

- Yeah, that's it.
- Oh, thank you for coming.

Keep a stiff upper, Robert.

* has being held on a charge
of murder in the first degree.

He may enter a plea if he wishes to do so

knowing that it will
be on record hereafter.

- Does the defendant wish to do so ?
- My client pleads, Your Honor.

So noted ! Now, seeing as
this is a first degree murder charge,

it is the opinion of the district attorney's
office the defendant should be remanded...

Your Honor, I object ! My
client is a respectable member...

Your client is accused of a
crime of premeditated violence

and thus the defendant is seen
as presenting a danger to society.

Therefore, I'm forced to concur with the
wishes of the district attorney's office

and I'm denying bail.

- Your Honor, I...
- And I am ordering defendant

for hearing or grand jury
action of a future date.

Next case !

Case number 62312. The People
of the State of New York versus...

Officer !

I suppose I owe you one.

- Let's just say that we're even, forever.
- Control, I did not ask to be broken out.

- Well, you want to clear yourself.
- Yeah...

Every cop in New York
City is looking for me.

Well... So the odds will
be against you a little bit.

- Very funny.
- Robert...

Seriously, my help ends here.

And I have a very hard time
explaining this little charade.

You don't call Jimmy, you don't
call Kostmayer or any of my people.

- We're out of it now, all right ?
- Oh, that's bad !

That means I've got to bring
something back on my own.

I've been on the run for years.

- Where the hell do I start ?
- Well, how about the girl ?

- Unless...
- Unless.

Unless you have already
run the address of the club.

Well, you would have hacked me or Joshua
until you got computer time, right ?

All right. So I ran all of the taxi
pickups and drops there yesterday.

There was only one. One cab picked up
one fare at the club yesterday morning.

- And took it to where?
- At a motel in New Jersey.

Here. The address is in there along
with a couple of other goodies.

Now you own me one.

Robert...

- If you don't come back with something...
- Yes, i know, I know.

Don't come back at all.

No, it'll be arranged. Disappear for a while.
Give me a chance to figure something out.

I can't do that.
You know me well enough for that.

Yeah, I quess so.

- All right, don't call me I'm going to Bermuda.
- You bloody hate Bermuda !

I bloody hate this.

Good luck, Robert.

So, that's what you mean by good news ?

McCall resists the arrrest.
He'll be shot dead on sight

and it'll be the cops that
pull the trigger, not one of us.

It's not what I had in mind, Tommy.

You didn't want him taken out, pop.

the heat was on so you were afraid to be
traced back so he had to be discredited.

Well, now he's broken out and the
frame is wrapped tighter than ever.

Even if he makes it to the stand next
month, your lawyer will eat him up.

A criminal at large
charged with murder...

They'll throw his testimony
out the window and you go free.

Unless McCall finds the girl.

For God's sake, stop smoking !

They get together, Rico hits
me with 20 years minimum.

You should have taken care of that,
as soon as her part was finished.

There was no guarantee that
McCall would meet with Clark.

If he didn't, we needed
her to push the issue.

By that time, Clark was dead
and she had already split.

We can't afford to let McCall find her.

- What are you worried about ?
- Keep your voice down !

The only thing that they can
get us with are the records.

- She has no idea where they are.
- But you do.

And the girl can lead McCal to you.

- Well, he won't find her !
- Don't underestimate him.

- I don't need a family reunion in here.
- Don't worry, pop.

I will until you set things straight.

Well, it's practically done. I've been
looking into these taxicab companies.

You see, they keep these records right.
They're locked up tight.

You startled me, Mac !

- This cab is free. I take it.
- Where to ?

- New York
- That's out of the city.

Will cost you double, bud.

You're all right. Fine, I'm good for it.

You're the boss as long
as you pay the costs.

New York.

- Like some music, Mac ? A little R&B ?
- Yeah, whatever you like.

Hey, Mac, you mind if I pull
over a second make a call ?

- Fine. Make it short
- It'll be short, buddy.

- If you have a pen or pencil ?
- Anything you want, Mac, sure.

Thank you.

One sec, bud.

Please, police !

Emergency number. What
can we do for you ?

Hey, I got that cat that kill
that blind dude, I am a taxi.

You sure it's him ?

I swear it's the same guy.

I just saw his picture
on the front page.

All right. So you have them
waiting in your taxI ?

Yeah !

Keep 'im there.

Yeah ? How the hell am
I supposed to do that ?

Uh, look... Tell him you got motor trouble.

He's already killed one dude.

Don't worry. Now, where are you located ?

Hold it, man.
He's got a 2x4 !

Hello ?

Hello ?

What's going on ?
What's going on ? Hello ?

Are you okay, mister ?

Hello ? Hello, mister ?

Take this.

You're not gonna believe this.

And if you would introduce our
next challenger...

apparently invincible
contestant, Emil Buran.

What...

Help !

Help !

Please, help me !

Help !

I'm in here !

Please !

Help ! Please, help me !

Help !

Please, help !

Step back !

Get back away from the door !

Come on ! Hurry !

Go in the cab.

Hey, you too !
****

Get back here !

- How'd you find me ?
- Explanations later.

I'm gonna get a change of
clothes and get rid of this cab.

Every policeman in New Jersey
will have a description by now.

And we'll need a car.

Sorry, I couldn't get anything bigger.

Let's go.

You really screwed things up, Tommy.

- They're still on the run...
-But they're together !

There's still a chance
the cops will gun him down.

Not if McCall finds out
what he needs from the girl.

He can be very persuasive.

If he gets a chance to talk
to the cops, they'll hang you

and I'll be in here for twice as long.

- This wasn't my idea, you know.
- Well, it is now.

- What are you saying, pop?
- That it's up to you to make things right.

I feel so ashamed.

I didn't know what the whole plan was.

If I'd known they were
setting you up for murder,

Yes. Well, I suppose
the fact that somebody's

is trying to kill you, is proof of that.

Now, they're obviously just
cleaning up after themselves.

All right, go on.

- So tell me.
- I don't know where to start.

Well, I tell you where you can start.

You start by telling me your real name.

It's Diane. Diane Snyder.

- Clark came up with Anne Fitzgerald
- All right.

Come on, come on !
What was Clark held over you ?

I got into a jam a couple of
years ago and needed some money.

Somebody put me in touch with Clark.

He was running the scam and needed
somebody to forge checks.

Took me a while to figure
out I wasn't making any money

and he had something
he could hold over me.

Are you...

Are you telling me that he suddenly
decided to cash in his chips ?

Out of the blue.

He said this would square us forever.

What he didn't tell me was
it also meant putting me away.

- Go on.
- What ?

With what ? You haven't
told me anything yet.

There's nothing more to say.

What do you mean nothing more to say ?
My life is on the line here.

Now, come on !
You've got a lot of explaining to do.

But you realize what kind of thing...

Wait for a second.

I'm being hunted in New
York City, New Jersey.

I am forced to behave like a
fugitive, all because you won't tell me...

You will give the information that you have.
For instance, who was Clark working for ?

Listen, I have never seen
that man before in my life,

but whoever engineered this setup
did it specifically to get at me.

Now, who was he working for ?

Let's get out of here.

Just let your boss
finish his telephone call.

I presume we have a back way out of here. huh ?

Thank you for the coffee.

- Now, what are we doing ?
- Rent another car. Come one !

- I don't want to keep going like this.
- But only you can stop it.

I can't !

- Who are you so afraid of ?
- I can't tell you.

But then we're lost. We're lost.

I cannot fight if I don't know
who it is I am supposed to fight.

Clark is dead.

I cannot go to the police with what you
say he forced you to do. I need proof.

- I'll say it again. Give me a name.
- I'm scared.

I met him only once.

- His name's Marley.
- Marley ?

But he can't be out
of prison. Describe him !

- Big, kind of scary looking. Early 30s...
- His son !

Marley's son !

That boy is a known arsonist.

Which explains his use
of fire at the motel.

- And he's gonna frame me ?
- You could say that, yes. Yes.

I am the key witness of
this trial next month.

- Come on !
- What are we gonna do ?

We're gonna stop running.

We're gonna put somebody else
through this nightmare. Come on !

*** I don't think either of us wants to
prove how fast we are on the ***, do we ?

What you doing here ?

Thomas Marley Jr .

- What does he have to do with you ?
- He set up the murder of Clark

to discredit my testimony
at his father's trial.

- Simple, just like that?
- Just like that.

Tomorrow, I'm going to
make you into a hero.

You are going to get a call telling you the
exact location where you can pick up Marley,

signed, sealed and ready
for long-term storage.

- I'm not making any deals...
- I'm not asking for any deals.

All I'm asking is for
24 hours, that's all.

What makes you think
I'll give you even that ?

Because I know that you already
suspect that I've been set up

and because I will give you my word

that if I do not deliver as promised,

I'll hand myself over to you
and suffer the consequences.

Drop me in the next corner, will you ?

Hey, you called me !

Hey, you wanted to talk to me ?

Hey, doll !

Hey, where are you ?

Don't move !

You ! You're a dead man !

And you are a fool !

Truth time !

I know that you set me up
for the murder of Tom Clark,

as an act of revenge and to stop me

from testifying against your father.

Prove it !

I don't have to prove it !
You're going to prove it !

I know your family. I know you keep
records of every single little transaction.

Well, I want to know where those
records are and I want to know now.

You're crazy, old man !

- I ain't telling you nothing !
- The most regrettable decision, Mr. Marley.

You know, I learned something.
For quite a long time I've known

that man's greatest obsession
is man's greatest fear.

And yours is fire, isn't it ?

How does it feel to face
the flames yourself, Marley ?

It's like all those victims
you've burned alive in the past.

You get nothing out of me ! Go to hell !

After you, si r!
After you !

Tom Clark's murderer.

All right !
All right !

We did to get you.

So tell me where the records are !
Now !

Stop it !

Stop it !

The records !

Okay !
Okay !

****

The mausoleum.

Now, leave the girl alone !

From this moment,
your life hangs on a thread.

And if I hear that you've been anywhere
near her again, I will destroy you entirely.

Remember that !

Is it over ?

Well, it'll be far too busy
to bother anyone for some time.

Now you can start a clean slate.

Thanks ! I will.

Why don't you actually start by
settling on a name for yourself ?

What do you mean ?

Oh, come on !

The gentleman who told me where you were
hold up also gave me a list of your aliases.

Diane Nielsen, Wendy or Patty Carson.
Bridget O'Shaughnessy ? Come on !

Can't blame a girl for trying.

What's wrong with your
real name, Jane Johnson ?

Do you know how many Jane
Johnsons there are out there ?

Well about as many Robert McCalls.
No one of them quite like me. Please, God !

Come on, I'll take you home
and I've got one more chore to do.

- You did well! You did very well !
- Thanks.

Midnight raids again, Igor ?

No, no, just laying
some old ghosts to rest.

Give me the files, Robert.

No, no, no, no, these are my only evidence.
I do not want them to walk in.

They won't, but they will
walk if you hand the file in.

It's because they come
from an anonymous source.

- Suppose you're right.
- It's better.

- Oh, thank you, for this.
- You're welcome.

- No sun in Bermuda ?
- What do you mean ?

Ah... No. I wasn't able
to get a flight actually.

You know, Robert, I was thinking
more along the lines of Pakistan.

Oh yeah ! Oh, very nice
there at this time of year.

It shouldn't be any difficult
to get a flight to Pakistan. Any problem ?

No, no, no problems.

Matter of fact, I got a first-class
flight with all of the amenities.

Now, me might have some problems...

We might have to rough it a
little bit after we get there.

- We ?
- We.

You're joking. Now way !

-Robert...
- No, no, no way !

- Robert...
- No, no, I am not going back to Pakistan !

Robert...

Have you forgotten I'm not
with you anymore ! Remember ?

Nnobody ! Nobody ! Nobody
knows that sector the way you do.

Besides... Besides, you're
already forgetting the great escape.

Now, I thought you said something
about us being even for life.

I lied.

All right, I'll owe you one.

- That's funny the way you always say that.
Oh, I'm just a creature of habits.

Just like you.

Always get trickly heat in pakistan.

I promise you this
time we'll get a bathroom.

- Thank you !
- You're welcome.

And no elephants this
time and no candles.

Will actually have a car.

Look, it'll just be a pleasant
long weekend. 72 hours in and out.

Robert ? Robert, you're
not saying anything.

Look if we leave Sunday...
